This Privacy Policy (“Privacy Policy”) governs your use of website, mobile application and technology operated by a joint venture “Yuma Energy” between Yulu Bikes Pvt. Ltd. and Magna International Inc.

We would like our users to know that we will collect and use your personal information for legitimate purposes. The policy below is applicable to data and information collected when you use any of the following services:

  1. Yuma Energy website: https://yuma.energy/ (including any versions optimized for viewing on a wireless or tablet device)
  2. Yuma App providing easy to use battery-swapping service (“App”)
  3. Any other Services, interactive features and communications

provided by the Yuma Energy, however, accessed and/or used that are operated, made available, or produced and maintained by us (collectively “Yuma” or “we”, “us”, or “our”). The purpose of this document is to provide you with information about the data we collect and process when you use our Services.

Please note that the practices described in this Privacy Policy apply to information gathered online through our yuma App and website, and by our customer service personnel. It does not apply to information that you share with organizations to which we may link or who may link to us, or information that we may receive about you from other organizations.

By using our App, you accept the practices described in our Privacy Policy. We reserve the right to revise the terms of our Privacy Policy from time to time without notice. Your continued use of services following the changes to these terms will mean you accept those changes. If we intend to apply the changes to this Privacy Policy retroactively or to personal information already in our possession, we will notify you of the modifications or amendments.

Information Collection and Use

We may request you to provide personally identifiable information for a better experience while using our services. We collect two basic types of information from you: personal information; and non-personal information. Personal information may mean any information relating to you personally, e.g., name, email address, user behavior. The information that you share with us will be retained by us and used as explained in this privacy policy.

  1. When you contact us by email, contact form, or via phone, we process the data you provide (e.g., email address, name and telephone number, company, contents of your message) to be able to respond to your inquiry.
  2. To prevent unauthorized access by third parties to your personally identifiable information, we take reasonable physical, technical, and administrative security measures to protect your data from loss, misuse, unauthorized access, disclosure, and alteration. These security measures include but are not limited to data encryption and pseudonymization, physical access restrictions to our data centers, and access authorization controls.

To connect a Yulu product to a battery, yuma App receives mobile phone number information of the end user from Yulu Bikes Pvt. Ltd.

Personal Information

We offer a number of services that can be accessed only by submission of the required personal information. The most common ways in which we may collect your personal information are listed below.

  1. If you use the website for information purposes, we collect the personal information that your browser transmits to our server. This information is stored in a log file:
    - IP Address
    - Date and time of the request
    - Specific page you visited
    - Access status
    - Amount of data transferred
    - The referring website
    - Browser
    - Operating system and its interface
    - Cookies (see separate section on cookies below)
    We process this data to ensure smooth connectivity of the website, to ensure that our website is user-friendly, to evaluate the security and stability of the system, and for other administrative purposes.
  2. If you use the yuma App, we process following personal information:
    - Employee Data: Name, Phone Number, Yuma ID
    - Profile information (personal and non-personal) provided by you in the yuma app User Profile
    - Log Data (see the section below)
    - User Activity (time of access, date of access, access duration,
    - Performance Data (amount of completed jobs, time stamps, ID of completed jobs)
  3. We also collect and process information about the battery:
    - State of battery
    - Charging information
    - Location of the battery
  4. Other services where data processing may occur:
    - When you participate in yuma ratings, surveys, or promotion
    - When you request for assistance, customer service or support
    - When you submit data or information on the app where it is permitted
    - When you knowingly volunteer personal information anywhere on the app

Log Data

When you use our Service and if there is an error in the App, we collect data and information on your phone, called Log Data. This Log Data may include information such as your device Internet Protocol (IP) address of your server, device name, operating system version, the app configuration while you are using our service, the time and date when you use our service, the duration, and other statistics.

The device information about the computer, browser, mobile device, or any other device that you use to access our services. This information may include the IP address, geolocation, unique device identifiers, type of browser, language, and other transactional information.

Additional “traffic data” and log files such as time of access, date of access, software crash reports, session identification number, access times, and referring app addresses.

Cookies

Cookies are files with small amount of data that is commonly used as anonymous unique identifier. These are sent to your browser from the website that you visit and are stored on your device internal memory. This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and to improve their services. Information Collected from Other Sources

Children’s Privacy

Our Services do not address anyone under the age of 13 years. We do not knowingly collect personal information from children under 13 years. In case we realize that a child under 13 years has provided us with personal information, we immediately delete this from our servers. If you are a parent or a guardian and are aware that your child has provided us with personal information, please contact us so that we will be able to take necessary actions.

How Do We Use Your Information?

With Whom is Your Information Shared?

Except as disclosed in this Privacy Policy, we do not disclose your Personal Information to any companies not part of yuma, or its controllers, or related entities. In no event will we sell or rent your Personal Information as part of a customer list or similar transaction.

Third-Party Agents

We have third party agents, subsidiaries, affiliates, and partners that perform functions on our behalf. These functions may include hosting, billing, push notifications, storage, bandwidth, content management tools, analytics, customer service, fraud protection, etc. These entities have access to your Personal Information needed to perform their functions and are contractually obligated to maintain the confidentiality and security of that Personal Information. They are restricted from using, selling, distributing, or altering this data in any way other than to provide the requested services to the App.

We may have to use or disclose Personal Information if required to do so by law or in a situation where such action is necessary to (a) conform to applicable law or comply with legal process served on us or the App; (b) protect and defend our rights or property, the App or our users, and (c) act under emergency circumstances to protect our personal safety and that of our affiliates, agents, or the users of the App or the public. How Can yuma Transfer Your Personal Information?

Your information collected through the App may be stored and processed in India where yuma, its Affiliates, Clients, or service providers maintain facilities. Wherever your personal information is transferred, stored, or processed by yuma, yuma will take reasonable steps to safeguard the privacy of your personal information. By registering for and using the App you consent to the transfer of your information to any other country in which yuma, its Controllers, Clients, Affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

What Steps Are Taken to Keep Personal Information Secure?

We are concerned about the security of your Personal Information. We practice great care in providing secure transmission of your information from your device to our servers. Your Personal Information collected by our App is stored in secure operating environments that are not available to the public. Our security procedures may require us to request proof of identity before we disclose your Personal Information to you.

What Happens When I Link to or From Another App?

This App may contain links to third party Apps/Offers. Please note that the practices described in this Privacy Policy for yuma do not apply to the information gathered through other Apps. We are not responsible for the actions and privacy policies of third-party Apps.

Governing Law

This App is published in India. We try to protect the Personal Information of all users of our App and we try to comply with local data protection and consumer rights laws to the extent they may apply to the Services. Our app is located and targeted to Indian citizens and our policies are directed at compliance with those laws. If you are unsure whether the practices of this privacy policy are applicable to the local privacy laws where you are located, you should not submit your Personal Information to yuma.

Assignment

We may change our ownership or corporate structure of yuma while providing the App. We may also sell certain assets associated with the App. As a result, please be aware that in such events we may transfer some or all of your information to a yuma acquiring entity all or part of our assets or to another entitywith which we have merged. Under such circumstances we would expect the acquiring party to follow the practices described in this Privacy Policy. However, we cannot promise that an acquiring entity or the merged entitywill have the same privacy practices or treat your information the same as described in this Privacy Policy.

Changes to This Policy

We may add new services and features to our App as we develop it. If these additions affect our Privacy Policy, this document will be updated appropriately. We will make those changes prominently so that you will always know what information we gather, how we might use that information and whether we will disclose it to anyone. However, we recommend that you read this Privacy Policy each time you use our App in case you missed our notice of changes to the Privacy Policy. We will make sure not to change our policies and practices to make them less protective of Personal Information we have previously collected from you without your express consent.

What Are Your Choices and How Do You Opt-Out?

Please note that by doing so you may not be able to access certain products and services, and we may continue to send non-promotional communications such as staffing confirmations, surveys, and other information about your use of the Service. If you refer others to us using our email functionality, please note that they may choose not to receive any promotional emails from us in the future by following the opt-out instructions in the email invitation.

You can review and change the information in your yuma account by logging into your account and editing your profile. Please note that we may not be able to delete your Personal Information without also deleting your user account. To access any records containing information about you, we may request you to provide us with your Personal Information to verify your identity. Please be advised that you will not be permitted to examine the Personal Information of any other person or entity. We may decline your request to change or delete Personal Information if we believe doing so would violate any law or legal requirement or cause the information to be incorrect.
